In accordance with the obligation imposed by Article 20 of the Constitution, the Personal Data Protection Law (KVKK) entered into force upon its publication in the Official Gazette dated 7 April 2016. The conditions for the retention, storage, processing and sharing of personal data with third parties, as well as the principles to be applied, are regulated in detail in the provisions of the KVKK and secondary legislation.<\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Kuans Office Furniture reserves the right to make updates and changes to this General Information Notice in accordance with the provisions of the Personal Data Protection Law (KVKK) and secondary legislation.<br \/><br \/><\/span><\/p><h3 style=\"font-weight: 500;\"><strong><span style=\"color: #0c3b5d;\">I. Personal data processed within this scope is processed in accordance with the law and relevant legislation, and for the duration necessary to achieve the stated purposes, limited to communicating with you and informing you about advertisements and campaigns.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">By completing the membership information on the Kuans Office Furniture website via the online system, freely ticking the box in the relevant section stating \"I have read and accept the Membership Agreement, General Information Text on the Protection and Processing of Personal Data\", and subsequently completing the membership process; the personal data of the relevant person (the person whose personal data is processed) relating to the establishment and performance of distance selling agreements, consumer agreements and other relevant agreements is processed by Kuans Office Furniture (processing includes recording, storing and archiving as defined in the Law).<br \/><br \/><\/span><\/p><h3 style=\"font-weight: 500;\"><strong><span style=\"color: #0c3b5d;\">III. DATA SECURITY<br \/><br \/><\/span><\/strong><\/h3><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Kuans Office Furniture shall establish the necessary systems and control mechanisms for the deletion, destruction or anonymisation of personal data it obtains, prevent the unlawful processing of data, prevent unlawful access to data, ensure the preservation of data and take all necessary legal, administrative and technical measures to this end; it will carry out and\/or have carried out the necessary audits in the event that the data is processed within its own organisation and\/or by another natural person and\/or legal entity, and will also take all necessary legal, administrative and technical measures.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Kuans Office Furniture hereby acknowledges, declares and undertakes that, in the event of personal data being unlawfully obtained by others, it will immediately (within a maximum of 72 hours as determined by the Board's decision) notify the data subject in writing and report the data breach to the Personal Data Protection Board, the administrative authority, via the system.<br \/><br \/><\/span><\/p><h3 style=\"font-weight: 500;\"><strong><span style=\"color: #0c3b5d;\">V. TRANSFER OF PERSONAL DATA<br \/><br \/><\/span><\/strong><\/h3><ol><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">\u00a0<strong>Transfer of Data Within the Country<\/strong><\/span><\/li><\/ol><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Kuans Office Furniture may only transfer the personal data it has obtained to third parties, whether natural persons or legal entities, located within the country with the explicit consent of the relevant individual.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">The transfer of an individual's personal data to a third natural and\/or legal person without their explicit consent is only permitted within the framework of the exceptions set out in Article 20 of the Personal Data Protection Law (KVKK) and specified below; it may be transferred to authorised persons and authorities in accordance with the Law and for a purpose related to it. These cases are as follows:<br \/><br \/><\/span><\/p><ul><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Explicitly provided for in the laws,<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Where a person is unable to express consent due to actual impossibility or where their consent is not legally valid, it is necessary for the protection of their own or another person's life or physical integrity.<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">The processing of personal data belonging to the parties to a contract is necessary provided that it is directly related to the establishment or performance of the contract.<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">It is mandatory for the data controller to fulfil their legal obligations,<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">The fact that the information has been made public by the person concerned,<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Where data processing is necessary for the establishment, exercise or defence of a legal claim,\u00a0<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Provided that it does not infringe upon the fundamental rights and freedoms of the data subject, the processing of data is necessary for the legitimate interests of the data controller,<br \/><br \/><\/span><\/li><\/ul><p><span style=\"color: #0c3b5d;\">\u00a0 \u00a0 \u00a02.\u00a0 <\/span><strong><span style=\"color: #0c3b5d;\">Transfer of Data Abroad<\/span><\/strong><\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Kuans Office Furniture may only transfer personal data it has obtained to third parties, whether natural or legal persons, located abroad with the explicit consent of the individual concerned.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">For personal data to be transferred abroad, the domestic transfer conditions specified above must be met, and in addition, the following conditions must be met in the foreign country to which the personal data will be transferred:<br \/><br \/><\/span><\/p><ol><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">The existence of adequate protection,\u00a0<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">In the absence of adequate safeguards, Kuans Office Furniture may transfer personal data abroad without seeking the explicit consent of the data subject, provided that the data controllers in Turkey and the relevant foreign country commit in writing to adequate safeguards and subject to the authorisation of the Board.\u00a0<br \/><br \/><\/span><\/li><\/ol><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">The countries that will be accepted into the category of \"countries with adequate protection\" will be determined and announced by the Personal Data Protection Board. If the Board announces that a country is secure, personal data may be transferred abroad without the need to obtain permission from the Personal Data Protection Board and without the need for data controllers in foreign countries to commit to protection in writing.<br \/><br \/><\/span><\/p><h3 style=\"font-weight: 500;\"><strong><span style=\"color: #0c3b5d;\">VI. RIGHTS OF THE DATA SUBJECT (THE NATURAL PERSON WHOSE PERSONAL DATA IS PROCESSED)<br \/><br \/><\/span><\/strong><\/h3><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Data subjects whose personal data is processed have the right to apply to Kuans Office Furniture as the data controller for the purpose of implementing the provisions of the Personal Data Protection Law (KVKK) and other relevant legislation. Pursuant to Article 11 of the KVKK, they are entitled to the following rights. APPLICATION TO THE DATA CONTROLLER<br \/><br \/><\/span><\/strong><\/h3><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">The data subject whose personal data is processed has the right to apply to Kuans Office Furniture, in its capacity as data controller, within the most appropriate time frame in relation to the exercise of their rights, should they wish to exercise their rights arising from the processing of personal data processed by Kuans Office Furniture or which they have learned has been processed.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">The relevant person acknowledges that they are obliged to submit their requests in writing, either by completing the information request form on the website and sending it by registered post\/notary channel, or by email with the subject line \"Request for Information Regarding the Personal Data Protection Law\", to Kuans Office Furniture.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">In order to exercise the rights specified in Section VI above, entitled \"Rights of the Data Subject\", the mandatory information that must be included in applications to Kuans Office Furniture in accordance with Article 5\/2 of the Communication on the Procedures and Principles for Applying to the Data Controller, published in the Official Gazette No. 30356 on 10 March 2018 and entered into force, are as follows: , applications made to Kuans Office Furniture must include the mandatory information listed below in order to be responded to in accordance with the law and regulations.<br \/><br \/><\/span><\/p><ol><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Name, surname and, if the application is in writing, signature.<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Turkish Republic identity number for citizens of the Republic of Turkey, nationality, passport number or identity number (if available) for foreign nationals.<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">The address of the principal place of residence or business premises for the purpose of service of process,<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">If available, the email address, telephone and fax number to be used for notifications,<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Subject of the request.<br \/><br \/><\/span><\/li><\/ol><p style=\"font-weight: 400;\" class=\"translation-block\"><span style=\"color: #0c3b5d\">The request letter containing the above-mentioned information and documents, along with explanations regarding the requested right, can be sent to the address Emek Mah. Ordu Cad. No:28\/A Sancaktepe \/ ISTANBUL, or it can also be sent to the email address <a style=\"color: #0c3b5d\" href=\"mailto:info@kuansofis.com\" target=\"_self\">info@kuansofis.com<\/a> email address.<\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Kuans Office Furniture undertakes and commits to respond to the requests included in the application as soon as possible and within a maximum of thirty days, depending on the nature of the request. If a written response is provided to the application, no fee will be charged for up to 10 (ten) pages in accordance with Article 8 of the relevant Circular; for each page exceeding 10 (ten) pages, a processing fee of 1 Turkish Lira will be charged.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">If the response to the application is provided on a recording medium such as a CD or flash drive, the data controller may charge a fee proportional to the cost of the recording medium.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Kuans Office Furniture, as the data controller, has the right to accept or reject requests made by the data subject regarding the exercise of their rights, providing justification for any rejection. In such cases, the data controller acknowledges its obligation to communicate its response to the data subject in writing or electronically. If the request contained in the application is accepted, the data controller acknowledges and undertakes that it is obliged to fulfil the request.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">In the event that the application is rejected, the response provided is deemed insufficient, or no response is provided within the specified timeframe (30 days), the relevant individual has the right to lodge a complaint with the Personal Data Protection Board within thirty (30) days of receiving the data controller's response and, in any case, within sixty (60) days of the application date.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Should the application be due to an error on the part of Kuans Office Furniture, the fee charged will be refunded to the relevant party.<br \/><br \/><\/span><\/p><h3 style=\"font-weight: 500;\"><strong><span style=\"color: #0c3b5d;\">IIX. UPDATE PERIOD<br \/><br \/><\/span><\/strong><\/h3><p style=\"font-weight: 400;\"><span style=\"color: #0c3b5d;\">Kuans Office Furniture reserves the right to unilaterally amend this General Information Text on the Protection and Processing of Personal Data at any time in accordance with its economic and commercial decisions or the principles of the Personal Data Protection Board.
